These Terms of Service ("Terms") govern access to and use of the websites, products, and services provided by Nastia Research (together, "Nastia", "we", "us"). By accessing or using these services, you agree to these Terms.
The service
Nastia provides conversational AI products and supporting research, including a consumer companion application available on the web and through mobile platforms. We may modify, add, or discontinue features at any time, with or without notice, although we will give reasonable advance notice of material changes wherever practicable.
Eligibility
You must be at least 18 years of age to use the consumer product. By using the service you represent and warrant that you are at least 18, that you have the legal capacity to enter into these Terms, and that your use of the service does not violate any applicable law.
Account
You are responsible for activity on your account, for keeping your credentials secure, and for any content you create or share through the service. We may suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.
Acceptable use
Use of the corporate platform, developer programme, and partner integrations is subject to our Acceptable Use Policy. Use of the consumer companion application is additionally subject to the in-app Community Guidelines and Content Policy. In all cases, you may not use the service to violate the rights of others, to break the law, or to interfere with the operation of the platform.
Subscriptions and billing
Some features of the service are offered on a subscription basis. Subscription fees are charged in advance and are not refundable except where required by law. We may change pricing with reasonable notice; existing subscribers will see the new pricing apply at their next renewal. Payment is processed by Stripe; see our Security page for details.
Intellectual property
The service, including all software, content, and trademarks, is the property of Nastia or its licensors. You retain ownership of content you submit to the service. By submitting content, you grant Nastia a non-exclusive, worldwide, royalty-free license to host, store, and process the content as necessary to provide the service to you.
Disclaimers
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Nastia disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The service relies on machine learning models that can produce inaccurate or unexpected output. The service is not a substitute for professional medical, legal, financial, or psychological advice.
Limitation of liability
To the maximum extent permitted by law, neither Nastia nor any of its officers, directors, employees, or agents will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim arising out of these Terms will not exceed the greater of (a) the amount you paid Nastia in the twelve months preceding the claim or (b) one hundred euros.
Termination
You may terminate your account at any time. We may suspend or terminate your access to the service if you breach these Terms, if your continued use poses a risk to other users or the platform, or if we are required to do so by law. Sections of these Terms that by their nature survive termination will continue to apply.
Governing law
These Terms are governed by the laws of France, without regard to conflict of laws principles. Subject to mandatory law for consumers, any dispute arising out of or related to these Terms will be brought before the competent courts of Paris, France.
Changes
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. For material changes, we will notify users through the service or by email where appropriate. Continued use after a change constitutes acceptance of the updated Terms.
